Jorge Barahona in Palm Beach County court after trial moved to Miami

The Miami man police say killed his adopted 10-year-old daughter and abused her twin brother, both who were found in his pesticides truck in West Palm Beach in 2011, was in a Palm Beach County court Friday morning, but no one seemed to know why.

Palm Beach County Circuit Court Judge Samantha Schosberg Feuer said Jorge Barahona’s Palm Beach County child abuse charges were consolidated with the first-degree murder charges in Miami earlier this year, so it didn’t make sense for him to be in the courtroom. Feuer said it must have been the court’s error for keeping the status check scheduled in Palm Beach County.

On Valentine’s Day 2011, a road worker found Barahona barely conscious in his pesticide truck on Interstate 95 in West Palm Beach. Barahona’s son, Victor, was found next to him near death with severe chemical burns officials say his father caused. The boy’s twin sister, Nubia, was also found in the truck, dead inside black plastic bag. Authorities believe she had been dead for days. After Barahona and his wife, Carmen, were arrested in 2011, stories of abuse the twins endured emerged in court documents, ranging from glued eyelids to being doused in bleach.

Originally, Barahona was set for a jury trial later this month on the abuse charges, but on May 9 the court ordered the two cases be tried together in Miami.

Feuer asked for the attorneys to write an order to to send him back so he could go on with case down south.

“Mr. Barahona, you’re going to go back to Miami,” Feuer said.

Barahona’s next court hearing is set August 4, according to Miami-Dade County clerk records. It’s unclear if a trial date has been set. Barahona’s wife, Carmen, is also facing murder and child abuse charges in Miami.
